Welcome to the ACB Technologies, LLC Website/Mobile App. We respect your privacy and have developed this Privacy Policy (“Policy”) to help you understand how ACB Technologies, LLC (“Company,” “We”, “Our”, “Us”) collects, uses, protects, discloses and shares your Personal Data when you visit our Website at acbtechnologiesllc.com, download and use our App, or use the KeyRing™ property management software platform and the related subscription services ("Services").
We may change this Privacy Policy at any time at our discretion. If we make material changes to this Privacy Policy, we will conspicuously state that we have updated the Privacy Policy on the Website and the App or otherwise communicate with you about the changes. All changes will be effective immediately upon posting to the Website and the App.
1. WHAT IS PERSONAL DATA?
For purposes of this Privacy Policy, “Personal Data” means any information that identifies or could reasonably be used to identify a natural person, excluding data which is publicly available or which is aggregated or de-identified.

We collect the following categories of Personal Data when you use our Website, create an account, use the App or use our Services:

3. SOURCES OF THE PERSONAL DATA WE COLLECT
We collect Personal Data from three primary sources: (a) information you provide to us when you communicate with us, visit our Website, use our App or use the Services; (b) information we collect automatically, including by use of cookies and online tracking mechanisms when you visit the Website or use our App; or (c) information from third party sources, such as property owners, property managers, landlords, and other businesses or individuals who subscribe to the Services (“Customers”) and who authorize their co-owners, employees, agents, bookkeepers, property managers, maintenance workers, third-party service providers, tenants, and tenant applicants (“Authorized Users”) to use the Services, or from public sources.

Payment Processors | We integrate the Services with certain services provided by third-party service providers, such as payment processing services and payment authentication services. We do not have access to your bank account information or credit or debit card information when you make a payment using the Third-Party Products. In particular, we integrate the Services with the following Third-Party Products: Stripe, Inc.: We use Stripe, Inc. and its affiliates (“Stripe”) to process payments made through the App. When you make a purchase or payment, certain information may be provided directly to Stripe, including your payment card information, billing information, transaction details, and other information necessary to process the payment and prevent fraud. Stripe's collection and use of your Personal Data is governed by Stripe's Privacy Policy available at https://stripe.com/privacy. Plaid Inc.: We use the services of Plaid, Inc. (“Plaid”) to securely connect to financial institutions across the U.S. To the extent you are based in the U.S., by entering online banking credentials for payment and completing checkout, your banking credentials are sent to Plaid for validation. Your Personal Data is processed by Plaid in accordance with the Plaid Privacy Policy available at https://plaid.com/legal/#consumers. |

6. DE-IDENTIFIED/AGGREGATED DATA
We may de-identify or aggregate your Personal Data so it can no longer be used to identify you as an individual (“De-Identified Data”). Once we do this, the information is no longer considered Personal Data, and we can use it for any lawful purpose, including but not limited to data analytics, benchmarking, research and identifying trends in the real estate market. We will not attempt to reverse this process or attempt to re-identify Personal Data once we have de-identified or aggregated that data.
7. INFORMATION WE PROCESS ON BEHALF OF CUSTOMERS AS A DATA PROCESSOR
Our Customers may permit Authorized Users to use the Services, including for communications purposes and to allow tenants to make certain payments using the Services.
The Personal Data we process will include information that Authorized Users submit to the Services. We process Personal Data of our Customers and their Authorized Users solely for the purpose of providing and supporting the Services and in accordance with our agreements with our Customers.
Our Customers are responsible for providing notices to and obtaining any required consents from any Authorized Users whose Personal Data they submit to the Services. Requests to exercise privacy rights relating to information processed on behalf of a Customer should be directed to the Customer and not to us.
8. COOKIES AND OTHER TRACKING TECHNOLOGY
We may use cookies, web beacons, pixel tags, and other tracking technologies (collectively "Cookies") on our Website and our App. A cookie is a small text file that our Services save onto your computer or device when you visit our Website or use our App.
We use these Cookies to collect and share certain Personal Data, such as your IP address and device ID, with third parties to assist in serving you with targeted advertising and to perform data analytics.

We maintain reasonable administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access or acquisition. While we take reasonable steps to protect Personal Data, no method of transmission over the Internet or method of electronic storage is completely secure. If we were to experience a Security Incident impacting your Personal Data, we will notify you in accordance with applicable laws.
10. SHINE THE LIGHT
California’s “Shine the Light” law (California Civil Code § 1798.83) permits California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. California residents may request (a) a list of the categories of Personal Data disclosed to third parties for their direct marketing purposes during the preceding calendar year, and (b) the names and addresses of the third parties that received such information. Please include your name, mailing address, and a statement that your request is made under “Shine the Light.” We will respond to properly submitted requests in accordance with applicable law.
11. LEAVING OUR WEBSITE AND/OR LINKING TO THIRD PARTIES
When you leave this Website or App and go to another linked website, we are not responsible for the content or availability of the linked website. We do not represent either the third party or you if you enter a transaction on the third-party website. The privacy and security policies of the linked websites may differ from our security practices. The inclusion of any link does not imply our endorsement of any other company, its website(s), or its product(s) and/or service(s). We are not responsible for the privacy practices or content of any other websites.
12. SOCIAL MEDIA
We are active on certain social media websites (e.g., Facebook, LinkedIn, TikTok, YouTube and Instagram) and share information with others.
If you contact us on one of our social media platforms, request Services, or otherwise communicate directly with us on social media, we may collect the Personal Data you share and contact you to interact with you. 13. CHILDREN'S PRIVACY
Our Website and App are not intended for or directed to individuals under 18 years of age or the age of majority in their state of residence. We do not knowingly collect any Personal Data from children under the age of majority. If a parent or legal guardian learns that their child provided us with Personal Data without consent, please contact us and we will make commercially reasonable attempts to delete such Personal Data.
14. DATA RETENTION
We will only retain Personal Data which we collect from you for as long as it is needed to meet our business and legal obligations.
15. INTERNATIONAL USERS
Our Website, App and Services are intended for use only within the United States. If you access our Website, App or Services from outside the U.S., please be aware that any Personal Data you provide may be transferred to, stored in, and processed in the United States, where our servers and operations are located. U.S. data protection laws may differ from those in your country of residence.
